These terms govern your use of the Avenstill application, website, and related services.
1. Agreement
By installing, purchasing, or using Avenstill, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service.
2. Wellness tool, not medical care
Avenstill is a general wellness and productivity tool. It is not a medical device, does not diagnose fatigue, pain, injury, emotion, posture disorders, or any health condition, and does not replace professional medical advice. Stop an activity if it causes pain, dizziness, or discomfort and seek qualified care when appropriate.
3. Camera permission
Camera-based features operate only after you grant permission and start a session. You are responsible for using the application in an environment where camera use is lawful and appropriate. You can pause a session or revoke permission at any time.
4. License
Subject to these Terms and any applicable purchase, Avenstill grants you a limited, revocable, non-exclusive, non-transferable license to install and use the application for personal or internal business purposes on the permitted number of devices. You may not resell, sublicense, reverse engineer beyond rights that cannot lawfully be restricted, bypass licensing controls, or use the service to violate law or third-party rights.
5. Early access
Early-access features may be incomplete, change without notice, or contain errors. We may modify or discontinue experimental features while preserving applicable consumer rights.
6. Subscriptions and billing
Paid plans, prices, billing periods, trials, device limits, and renewal terms are displayed before checkout. Paddle is expected to act as merchant of record and may provide checkout, tax collection, invoices, refunds, and subscription management. Subscriptions renew until canceled. You can cancel through the Paddle customer portal; cancellation normally takes effect at the end of the paid period unless law requires otherwise. Eligibility and request instructions are described in our Refund Policy.
7. Updates
We may provide updates for security, compatibility, reliability, or functionality. Microsoft Store versions may update automatically under your Store settings. Some updates may be required for continued access to online or licensed features.
8. Acceptable use
You must not interfere with the service, submit malicious content, probe systems without authorization, automate abusive requests, impersonate others, or attempt to obtain another person's subscription or feedback data.
9. Availability and warranties
To the maximum extent permitted by law, Avenstill is provided “as is” and “as available.” We do not promise uninterrupted operation, perfect detection, a particular health outcome, or compatibility with every camera, computer, lighting condition, or workplace policy. Statutory warranties that cannot be excluded remain unaffected.
10. Limitation of liability
To the maximum extent permitted by law, Avenstill Software is not liable for indirect, incidental, special, consequential, or punitive damages, loss of data, lost profits, or business interruption arising from use of the service. Our aggregate liability will not exceed the amount you paid for Avenstill during the twelve months before the event giving rise to the claim. This limitation does not apply where prohibited by law.
11. Termination
You may stop using Avenstill at any time. We may suspend access for material violation, fraud, security risk, or nonpayment, with notice when reasonably possible. Provisions that by nature should survive termination will survive.
12. Governing terms
Mandatory consumer protections in your country remain applicable. The verified seller identity and governing jurisdiction shown at checkout or in the applicable store listing form part of these Terms.
